On July 23, 2026, members of Congress reintroduced the Right to IVF Act, comprehensive legislation designed to protect access to assisted reproductive technology (ART) and expand access to fertility care across the United States.
The legislation was introduced by Representatives Representatives Lori Trahan (MA-03), Rosa DeLauro (CT-01), Rick Larsen (WA-02), James Walkinshaw (VA-11), and Laura Gillen (NY-04), along with Senators Tammy Duckworth (IL),Patty Murray (D-WA), Cory Booker (D-NJ), and Chuck Schumer (D-NY). The bill was reintroduced in response to growing legal uncertainty surrounding fertility care following state actions and court decisions that have raised concerns about continued access to IVF and other assisted reproductive technologies.
If enacted, the Right to IVF Act would:
- Establish federal protections for patients seeking fertility treatment and the health care providers who deliver that care.
- Safeguard access to IVF and other assisted reproductive technologies by preventing states from restricting medically appropriate fertility treatment.
- Require insurance coverage for IVF and IUI through Medicare and Medicaid, Affordable Care Act Marketplace plans, and health plans for veterans, service members, and federal employees.
- Expand access to fertility care by addressing financial barriers that prevent many individuals and families from pursuing treatment.
- Support continued innovation and research in reproductive medicine while protecting evidence based standards of care.
