Our priorities for the 2025-26 Legislative Session:
Update the current law on private health insurance coverage for fertility care
An Act Relating to Insurance (H.5629)
This bill updates the language related to private insurance to coverage of fertility treatment and medically necessary fertility preservation to align with the standard of care. Currently the definition of infertility in Rhode Island is outdated and gendered.
Expand Medicaid coverage for fertility care
An Act Relating to State Affairs and Government – Rhode Island Medicaid (H.5771)
This bill would require the Medicaid program to provide coverage for fertility diagnostic care, standard fertility preservation services, and fertility treatment. This would include fertility medications, monitoring and intrauterine insemination.
Current Rhode Island Fertility Insurance Law
Rhode Island has a Fertility Insurance Law. It passed in 1989 and has been amended several times.
Summary
The Rhode Island Fertility Insurance Law provides coverage for:
- Diagnosis and treatment of infertility for women between the ages of 25-42
- Fertility preservation
Legal Definition of Infertility
“Infertility” means the condition of an otherwise healthy individual who is unable to conceive or sustain a pregnancy during a period of one year.
Limits
The health insurance contract may limit coverage to a lifetime cap of $100,000.
Exemptions
Employers who self-insured are exempt from the Rhode Island insurance mandate requirements.
