The administration’s proposed rule allowing employers to voluntarily offer fertility benefits as “excepted benefits” may increase access for some individuals. However, the proposal falls short of the comprehensive, guaranteed coverage that patients across the country need and deserve.
Because participation is optional for employers, this approach may further fragment fertility coverage rather than create equitable access nationwide. Allowing employers to determine eligibility and coverage design also raises concerns about unequal access to care, particularly for LGBTQ+ individuals and couples, and single parents by choice. Family building care should be inclusive, equitable, and accessible to all people who need it.
Expanding access to fertility care will require comprehensive policy solutions that establish meaningful, nationwide protections and coverage standards.
